Terms of Use

These Terms of Use ("Terms") apply to the BePaid early-access waitlist ("Waitlist") operated by BePaid ("we", "us", "our"). By joining the Waitlist you agree to these Terms.

1. The Waitlist is not a live service

BePaid is currently in pre-launch. Joining the Waitlist does not give you access to any live product, does not constitute a contract for services, and does not create any obligation on our part to launch on a particular date or at all.

No payment is taken when you join the Waitlist. You will not be charged anything unless you separately sign up for the BePaid service after it launches and agree to pricing at that time.

2. Founder pricing

Waitlist members may be offered "founder pricing" or early-access pricing when the service launches. Any such pricing offer is a benefit of early access and is subject to the full terms and conditions that will apply to the service at launch, which have not yet been finalised.

Founder pricing is a commercial benefit, not a contractual commitment. We reserve the right to amend, limit, or withdraw any early-access pricing offer before the service goes live, with notice to affected waitlist members.

3. Founders' Leaderboard referral promotion

3.1 Nature of the promotion

The Founders' Leaderboard is a skill-based promotion. Positions on the leaderboard are determined entirely by the number of valid referrals each participant generates. It is not a game of chance and is not a lottery or trade promotion lottery under applicable Australian law.

3.2 How it works

Each waitlist member receives a unique referral link. When another person joins the Waitlist using that link, the referrer's count increases by one. The participants with the most verified referrals at the time prizes are awarded will receive the stated prizes.

3.3 Verification

We reserve the right to verify all referral activity before awarding prizes. Referrals generated by bots, scripts, duplicate accounts, self-referral, or any other artificial or fraudulent means will be disqualified. We may disqualify any participant we reasonably believe has engaged in such conduct.

3.4 Prizes and award timing

Prizes will be awarded at or around the time of service launch. We reserve the right to amend the prize structure, extend or shorten the promotion period, or cancel the promotion entirely if circumstances reasonably require it. In the event of cancellation, no prizes will be awarded and participants will have no claim against us.

3.5 Eligibility

The promotion is open to Australian residents aged 18 or over. Employees and contractors of BePaid and their immediate family members are not eligible.

4. No guarantee of debt recovery

BePaid is a tool to help you send a solicitor-reviewed Letter of Demand. Sending a letter does not guarantee that a debt will be recovered. We make no warranty, express or implied, that using BePaid will result in payment of any overdue invoice.

Nothing in the BePaid service constitutes legal advice. For advice about your specific situation, consult a qualified Australian lawyer.

5. Nothing is sent on your behalf without your authorisation

Once the BePaid service launches, no Letter of Demand or other correspondence will be sent on your behalf until:

  • You have created an account and agreed to the terms that apply to the service
  • You have selected the specific invoice or invoices you wish to escalate
  • A solicitor has reviewed and approved the letter through the relevant Incorporated Legal Practice
  • You have confirmed the send

The Waitlist does not authorise us to take any action on your behalf now or in the future.

6. Your information

We handle the personal information you provide when joining the Waitlist in accordance with our Privacy Policy.

7. Intellectual property

All content on this website, including text, graphics, and code, is owned by or licensed to BePaid. You may not reproduce, distribute, or create derivative works from our content without our written permission.

8. Limitation of liability

To the maximum extent permitted by Australian law, BePaid is not liable for any loss or damage arising from your use of, or inability to use, the Waitlist or this website. This includes indirect, consequential, or incidental loss.

Nothing in these Terms limits any right you may have under the Australian Consumer Law.

9. Governing law

These Terms are governed by the laws of Victoria, Australia. Any dispute will be subject to the exclusive jurisdiction of the courts of Victoria.

10. Changes to these Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Waitlist after a change constitutes acceptance of the updated Terms.
